Terms and Conditions

Please read these terms and conditions (the "Terms") carefully before registering for Alpenrundfahrt (the "Event"), as they limit your legal rights and obligations, including your right to assert any claims against Bär & Karrer AG (the "Organizer") and/or any of its representatives.

I acknowledge that my registration is only an application which must be confirmed by the Organizer and that the Event is not a public event, but a privately organized social event for friends as well as friends of friends of the Organizer's cycling group BK Cycling. The Organizer may in its sole discretion deny my registration.

I acknowledge that the Event is not a race. I undertake to adhere to the instructions and principles of the Organizer (the "BK Cycling Principles") at all times. I acknowledge that the BK Cycling Principles may be amended at the discretion of the Organizer at any time, and include but are not limited to the following:

- Wearing a helmet, glasses and weather-appropriate attire while riding is mandatory;
- Using head and tail lights at all times;
- Avoiding risky maneuvers that could jeopardize myself, other riders or traffic in general;
- Leaving no rider behind and always riding in small groups of two to three riders; - Not riding in groups that may disturb or hold up the traffic in general and gap when needed so that the traffic can flow easily;
- Offering assistance to other riders in case of technical defects or medical need; and
- Dialing 144 or 1414 in case of emergency as well as informing the Organizer under +41 79 290 43 94.

I acknowledge that the Event is not a race. I undertake to adhere to the Swiss Road Traffic Act (Strassenverkehrsgesetz) and related regulations at all times. 

I respect road signs, traffic lights and I adapt my speed to the circumstances at any time. I confirm that my bike and I meet all Swiss legal requirements for participating in public road traffic, pursuant to the Swiss Road Traffic Act and related regulation.

Participation is at my own risk and I have taken out accident and health insurance covering my participation and liability insurance covers damages of others. I acknowledge the risks associated with participating in the Event, including but not limited to damage to my equipment, physical injury and I confirm that my physical fitness and health status is suitable for the Event.

I waive any and all claims (actual or contingent) against the Organizer and/or any of its representatives related to my participation, including injuries or damages, to the fullest extent permitted by Swiss law. I agree that I will not assert any claims (based on a contract, for misconduct or on any other grounds) against the Organizer's, representatives, partners or personnel. The liability of such individuals shall be excluded to the greatest extent permitted by Swiss law.

I confirm having sufficient insurance to cover potential costs related to liability towards third parties (Privathaftpflichtversicherung), accidents and medical needs.

I agree to the use of images on which I may be visible for promotional purposes related to the Event.

I am solely responsible for arranging and covering all costs related to my travel and accommodation for the Event. I agree that the Organizer shall not be liable for any accommodation-related expenses, nor shall any refunds be provided should I be unable to attend the Event for any reason or the Event is cancelled for any reason.

The Organizer reserves the right to alter or cancel the Event due to unforeseen circumstances or any other reason without refunding or covering costs.

If any provision is deemed invalid, it does not affect the validity of the remaining provisions of these Terms.

These Terms shall be construed and interpreted in accordance with, and governed by, the substantive laws of Switzerland, under the exclusion of the Swiss conflict of laws rules. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the City of Zurich (Zurich 1), Switzerland.
